Steve Pratico Wins Multi-Million Dollar Real Estate Dispute for Seller

Partner Steve Pratico successfully defended the seller against a lawsuit seeking specific performance of contract and multi-million dollar damages where the buyer claimed the seller failed to disclose known complications with the property and failed to act in good-faith to help the buyer resolve these issues. When the buyer assumed another prospective buyer was involved, they sued, alleging a breach of contract and attempted to enforce the terms of its option contract with the seller.
A final judgment was issued in the seller’s favor, including an award of attorney’s fees to the seller. The key legal arguments that led to this highly favorable outcome centered on plaintiff’s waiver by termination of the option contract, plaintiff’s failure to satisfy the condition precedent of notice, and defendant’s opportunity to cure alleged defaults.
