Daniel J. Fleming Secures Jury Verdict on Behalf of Long Time Client Curry Controls Company

On June 27, 2019, Daniel J. Fleming, Esq. of Johnson Pope Bokor Ruppel & Burns, LLP’s Litigation Division secured an $80,000.00 jury verdict on behalf of client Curry Controls Company.  Curry Controls Company entered into a subcontract agreement with Defendant contractor RTD Construction, Inc. for engineering services on the Peace River Manasota Regional Water Supply Authority, Peace River Facility Rebuild Project.  RTD Construction failed to pay Curry Controls Company as agreed in the Subcontract for work completed and further failed to address Curry Controls Company’s claim and dispute in a timely manner breaching the subcontract agreement.  Curry Controls Company filed suit and a proposal for settlement prior to trial in the amount of $50,000 which RTD Construction, Inc. rejected  At the conclusion of the four-day jury trial, the 6 person jury found in favor of Plaintiff Curry Controls Company awarding $80,000.00 against RTD Construction.  Final Judgment against RTD Construction, Inc., was entered July 15, 2019.  Plaintiff Curry Controls Company’s Motion to Tax Costs and for Attorney’s Fees pursuant to the proposal for settlement is pending.
